Terms & Conditions

We don’t want to get bogged down in complex legal jargon or irrelevant and unfriendly conditions so we will try to keep it simple.

A few simple definitions:

“The Hirer” is the person(s) or organisation who books the band and who has confirmed the booking by providing us with a deposit and who is responsible for paying the balance of the booking fee (including any “waiting fee”).

The ‘Band’ consists of those musicians who are regular members of DisCoVeRed and whose details appear on the website.

The ‘Bandleader’ (for booking purposes) is John Neighbour of 18 West Chiltern, Woodcote, Oxfordshire, RG8 0SG

“The Venue” is the place where the performance will take place.

The Bands Rider

The Hirer will make every effort to accommodate the “Bands Rider”.

The Venue

It is the responsibility of the Hirer to ensure that the Venue is suitable for such an event to take place and that it can accommodate the band and it’s equipment safely, in particularly the provision of a constant 230-volt mains supply. If the band should subsequently, or on the day of performance, discover that the power supply could cause harm to personnel and/or damage the bands equipment this may constitute a valid reason for non-performance.

Licences

It is the responsibility of the Hirer to ensure that the Venue has the appropriate licences for the performance of Live and Recorded music.

Performances Outside

In the event that the band is required to play outside then an adequate waterproof awning with protection to the sides and rear must be supplied.  In the event of weather conditions prevailing that make it unsafe to perform the band may elect to stop until weather conditions change.

Payment of Fee

The Hirer will pay the balance of fee (including ‘waiting fee’) to the band on the night of the performance in cash.  Any other form of payments must be agreed at least 7 days before the date of the event.

Midnight Curfew

Unless previously agreed in the terms of the booking, the band will require an extra payment if asked to play beyond midnight.

Force Majeure

In the case of any situation arising on or before the event date which renders it impossible for the band to fulfil our obligation to perform, which is not attributable to any act or failure to take preventative action by the ‘band’, then the ‘band’ or ‘hirer’ may cancel the performance without penalty other than loss of any deposit already paid.

Changes on the day

If there are unavoidable changes to the terms of the booking on the day, the band will try to accommodate these as best as possible.

Where the time available for performance has unavoidably been reduced to something less than the agreed timings, the band will perform for as long as is possible up to the curfew subject to appropriate breaks for refreshment and recovery.

Early Set up

The band will usually expect to set up 2 hours before performance.  If an early set up is required an additional fee may be necessary which is based on an hourly rate of £20 per hour (or part thereof) per band member.

Cancellation

Cancellation must be in writing to the bandleader.   Cancellation in writing by the hirer any time up to 14 days of the event will incur loss of deposit only.  The FULL fee will be payable if cancellation occurs within 14 days of the event date.

Use of “Deps” or Deputy Musicians

The ‘band’ will perform using the instrumentation of the ‘band’ as advertised to the ‘engager’ unless the need arises to use an alternative (‘dep’) musician, due to unforeseen circumstances. The ‘band’ will have ‘dep’ musicians on call to cover all eventualities, and reserves the right to use one or more of these if the need arises. There will be no reduction in the contracted fee if a ‘dep’ musician is used, and the use of one or more ‘dep’ musicians does not constitute grounds for cancellation.

Complaints

In the event of a dispute or complaint from either party, the issue must be put in writing within 30 days to the bandleader. Payment must not be withheld from the ‘bandleader’ as late payment fees may be applicable.

Third party statements should be obtained where possible to back up any claim. If the matter cannot be resolved or an agreement reached, then both parties should seek legal advice.  The band will seek representation by the Musician’s Union under the terms of membership no. 1003786.
